These terms and conditions set out the basis on which you can use our website and place orders for items from Designer Sofas Direct. By ordering goods from Designer Sofas Direct you are deemed to have understood and accepted these terms. The supplier of the goods featured is Designer Sofas Direct, a trading name of Brynwood Holdings Limited, (“Designer Sofas Direct”, “we”, or “us”). Telephone calls to and from Designer Sofas Direct will be recorded and monitored as part of our efforts to further improve service to our customers. We may contact you for marketing purposes by email, mail or telephone with relevant offers from the following Brynwood Holdings Limited companies: Designer Sofas Direct. We may also contact you for market research purposes. * For call charges contact your service provider.

How We Use Your Information

When you apply for credit we will make searches about you at credit reference agencies who will supply us with credit information, as well as information from the Electoral Register. The agencies will record a search which can be seen by you, Designer Sofas Direct and other lenders on your credit file, whether or not credit is granted. We may use credit scoring methods to assess your application and to verify your identity. Credit searches and other information which is provided to us and/or the credit references agencies, about you and those with whom you are linked financially, may be used by Designer Sofas Direct and other companies if credit decisions are made about you or other members of your household. This information may also be used for debt tracing and the prevention of money laundering. Information held about you by the credit reference agencies may already be linked to records relating to people with whom you are linked financially. For the purposes of credit searching you may be treated as financially linked and you will be assessed with reference to any ‘associated’ records. If we enter into a credit agreement with you we will also supply details of your agreement with us to the credit reference agencies. If you do not pay on time, or in full, we will advise the credit reference agencies who will record details of the debt. All this information will be seen by other organisations carrying out later searches. Adverse entries regarding the conduct of your account will remain on your credit file for up to six years. The credit reference agencies may also use the records for statistical analysis about credit, insurance and fraud. You have the right of access of your personal records held by credit reference agencies and we will supply their names and addresses upon request to the Data Protection Manager, Designer Sofas Direct, Millers Avenue, Brynmenyn Industrial Estate, Brynmenyn, Bridgend, CF32 9TD. Some of the information you provide may be transferred outside the European Economic Area for processing. However, strict rules regarding the confidentiality and security of your information are in place to safeguard it.

Shopping With Designer Sofas Direct Using A Credit Or Debit Card

Customers can pay for items as they are ordered by credit or debit card or PayPal. The terms and conditions set out below will then apply.

Orders And Contract Information

Your order for goods is accepted and a contract is formed between Designer Sofas Direct and you when we despatch the goods you have ordered and not before. A contract is not formed at the point in time that payment has been taken from you by Designer Sofas Direct, nor at the point in time that you receive an email from Designer Sofas Direct acknowledging receipt of your order. Until the goods are despatched the order may not be accepted by Designer Sofas Direct or may be cancelled by you. Exceptions apply to orders for personalised items and goods made to your order which cannot be cancelled by you once you have received email confirmation that your order has been received; as such items and goods may already be in production as a result of your order. For a full list of exceptions please see under the heading EXCEPTIONS TO THE RETURNS POLICY. For security reasons we may restrict the volumes of certain items to be sold in any one transaction. Following formation of the contract Designer Sofas Direct shall continue to own any goods ordered until it has received payment in full from you even though the goods may have already been delivered to you.

Delivery Charges

Standard courier delivery charge to home is £2.50 for fabric/leather swatch requests. We do not deliver outside mainland England and Wales.

Free Delivery Offers And Order Codes

Free delivery offers are subject to availability.  Free delivery and other offer codes remain the property of Designer Sofas Direct, are non-transferable and may not be reproduced in any other form or used in conjunction with any other offer.  Delivery times cannot be guaranteed. We currently only deliver to mainland England and Wales.

Cancellation

Under Consumer Regulations you have the right to cancel your order as long as you do so no later than 14 days after the day on which you receive the goods or service. Please be aware that your right to cancel does not apply to certain goods that we sell, for example, items made to your order. You must inform us of your wish to cancel in writing either by letter, email or by calling 01656 725525 within a period of 14 days beginning on the day after the day you receive your goods. You must take reasonable care of the goods and not use them. You should return goods to us in their original packaging, wherever possible, within 14 days of informing us of your wish to cancel. If you return goods to us, we will not be responsible for any loss or damage to them during transit and we recommend that you use a recorded or secure delivery method. If goods are lost or damaged in transit, we may charge you, or not refund to you, amounts that are attributable to the loss or damage. We cannot accept substitute or alternative items by way of returns nor are we able to send them back to you, so please look closely at the items you return to us. If you return or attempt to return substitute or alternative items you will still be responsible for paying for the original item purchased and we reserve the right to charge an investigation fee of no less than £35 to cover the cost of our investigating the position. We can offset this amount due from other sums that may be due to you for refunds etc. Accepting returned goods and/or crediting an account does not constitute a waiver of our right to charge an investigation fee. Full details of how to return goods can be found in the RETURNS section. Additional terms and conditions apply to cancelling orders for certain goods such as made to order items and large items of furniture.  Please refer to the terms relating to the supply of those goods. Additional Delivery Charges: same day and evening delivery charges will not be refunded if you cancel or return your order.

Exceptions To The Returns Policy

The following exceptions apply to our standard returns policy.  A non-refundable collection charge of £60.00 will be applied to furniture and upholstery items if delivery is refused, or collection is requested, unless the product is faulty or does not fit the description given. No refunds or exchanges can be given on items made to your specification, such as bespoke and made to measure items.  Gift cards/eGiftcards/vouchers cannot be returned or exchanged for cash. Returned items which are not in new or unused condition may not be fully credited to your account unless they are faulty.

Prices

UK.  The prices shown are inclusive of any value added tax or sales tax. Due to circumstances beyond our control, prices may have to be altered up or down, including any alterations to the rate of value added tax or sales tax. The current price will be shown when you place your order. All prices shown are cash prices in sterling. Prices of goods displayed in and ordered through the website may differ from prices in-store.

Usage

All products are sold on the basis that they are suitable for domestic use only. Please contact us for further information if you intend using any products in a business or public environment.

All orders for products are subject to availability.

Colour Reproduction

Designer Sofas Direct take great care with the colours used in the collections. The limitations of colour reproduction and the individual colour settings of your screen may mean a slight variation. Every reasonable care has been taken to ensure that the descriptions are accurate. However, specifications may change.

Complaints

Designer Sofas Direct welcomes and learns from complaints. We aim to deal with complaints speedily and sympathetically. All complaints are logged, investigated and replied to. In the unlikely event we have been unable to resolve your complaint:

Customer Ratings And Reviews

These Terms of Use govern your conduct associated with the Customer Ratings and Review service offered by Designer Sofas Direct (the "CRR Service"). To the extent of any conflict between our Privacy Policy and these Terms of Use, these Terms of Use will take precedence in respect of the CRR Service. 

By submitting any content to Designer Sofas Direct, you represent and warrant that:

  • You are the sole author and have not copied the content from any third party;
  • All content that you post is accurate;
  • Use of the content you supply does not violate these Terms of Use and will not cause injury to any person or entity. You further agree and warrant that you shall not submit any content:

For any content that you submit, you grant Designer Sofas Direct a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.

All content that you submit may be used at our sole discretion. We reserve the right to change, condense or delete any content on our websites that we deem, in its sole discretion, to violate the content guidelines or any other provision of these Terms of Use. We do not guarantee that you will have any recourse through Designer Sofas Direct to edit or delete any content you have submitted.

Ratings and written comments are generally posted within two to four business days. However, we reserve the right to remove or to refuse to post any submission for any reason. You acknowledge that you, not Designer Sofas Direct, are responsible for the contents of your submission.

None of the content that you submit shall be subject to any obligation of confidence on the part of Designer Sofas Direct, its agents, subsidiaries, affiliates, partners or third party service providers and their respective directors, officers and employees.

By submitting your email address in connection with your rating and review, you agree that Designer Sofas Direct and its third party service providers may use your email address to contact you about the status of your review and other administrative purposes.

Made To Order Sofas and Chairs Terms & Conditions Only

Please check your measurements. All products are to fit the measurements you have provided and are made to order and orders cannot therefore be cancelled or altered once the order has been placed. 
WE STRONGLY RECOMMEND THAT A FREE FABRIC SAMPLE IS ORDERED TO ENSURE THE COLOUR AND TEXTURE ARE TO YOUR LIKING as computer monitors vary greatly in colour and shade representation and are not an exact representation of the product.

Cancellations

As all items are made to order, cancellation is not possible once the order has been placed. This is due to the products' bespoke nature.

Returns

Products are all made to order so can only be returned if faulty, or not made to the specification given. If you wish to arrange for goods to be returned, please contact customer services on 01656 725525. If the products are considered faulty by Designer Sofas Direct we will at our discretion either rectify the problem or offer a full refund and you will incur no return postage costs. If the returned goods are found not to be faulty a fee for carriage will be charged at £60 per order (to include collection and re-delivery) and the goods will be returned to you with no credit being made to your account or refund given.

Availability

All products are subject to availability. Availability is usually advised when placing an order but if this is not possible we will advise of any delay as soon as possible.

Usage

Before You Order Furniture And Sofas

Please check the dimensions of your chosen sofa, or furniture item, making sure it will fit through ALL of the doors, hallways, up the stairs, round tight corners to its final destination. Handy hint: In our experience using a tape measure and some paper to lay out on the floor to match the dimensions provided gives you a great feeling for how much floor space our items will take in your homes.

When ordering a Sofa you can order a free swatch of fabric to be sure of the colour and texture – call 01656 725525. When you have made your choices and are ready to place your order, we will tell you the time it will take to deliver your furniture or sofa.

We deliver seven days a week except for bank holidays.

If you order more than one item, we will only charge you one fee and we will tell you what this is before your order is placed. If you do order more than one item the delivery date we offer is based on the item with the longest delivery date.

When your items are ready for delivery, we will contact you to offer you a delivery date
 

The Day Of Delivery Of Your Furniture Or Sofa

Please make sure you are there to accept delivery at the time we have arranged and that our delivery staff will have clear access to bring in your goods.

Sofas and other large assembled furniture items will be placed in the room of your choice. Once we have unpacked your item you will be asked to check them. Self- assembly items will be placed in their box in the room of your choice.

If you are not at home to accept delivery at the agreed time, or refuse delivery we will charge you £60 for missed delivery.

Cancelling Your Furniture Or Sofa Order 0-14 Days

We hope you will be delighted with your furniture, but if you do change your mind, under the Consumer Contracts Regulations 2013 you have the right to cancel your furniture or sofa order within a period of 14 days. The period of 14 days begins on the day after the day you receive your goods.

You must inform us of your wish to cancel in writing either by letter, or email within a period of 14 days beginning on the day after the day you receive your goods. However please feel free to call us to help you with this process on 01656 725525.

If you have cancelled your order and are awaiting collection, you must take reasonable care of the goods. You may inspect and assess them, but not use them. Please return goods to us in their original packaging, wherever possible. Please make sure all parts and fittings are returned to us. If you return goods to us without arranging collection, we will not be responsible for any loss or damage to them during transit and we recommend that you use a recorded or secure delivery method. If goods are lost or damaged in transit, we may charge you, or not refund to you, amounts that are attributable to the loss or damage.

Cancelling Your Furniture Or Sofa Order 15+ Day

After 14 days you no longer have the right to cancel your order if you change your mind. The period of 14 days ends on the 15th day after the day you receive your goods.

At our discretion, within a reasonable time period, we will endeavour to accommodate your request to cancel. However, we would want to carry out an independent inspection of the goods in your home prior to collecting to ensure the goods are fit for re-sale. Subject to the results of the inspection we will arrange collection and charge you a re-stocking fee of £100. This fee covers the costs of the independent inspection, plus carriage back to our warehouse. Please feel free to call us to help you with this process on  01656 725525.

Until your order has been inspected and whilst the goods are awaiting collection you must take reasonable care of the goods. You may inspect and assess them, but not use them.

Faulty Items

  • If you believe any item of furniture is faulty, please contact us on 01656 725525 as soon as you become aware of the fault. We will arrange for an independent expert to come and inspect the item at your home. If possible, they will arrange for the fault to be repaired. If your furniture has been found to be faulty within 30 days of receipt and you do not want a repair or replacement, you may tell us after inspection that you choose to reject the item and wish to receive a full refund.
  • If the item cannot be repaired, or you have rejected it within 30 days of receipt, we will arrange to collect the item at no charge and will either replace it or issue a refund.

Refunds will be made back to the card used for payment.
